Role

Plans, organizes, and directs the activities of the Asset Recovery department. Makes final decisions regarding action on delinquent loans/accounts, including workout loans and extensions. Coordinates paralegal effort of delinquent accounts with the company’s legal counsel. Refers charged off accounts and monitors results with collection agencies. Liaison with credit reporting agency to assure files are properly maintained. Represents the company in small claims, municipal and bankruptcy courts. Directs the filing of bond claims. Conducts risk analysis and mitigation. Identifies risk management issues and trends and provides reporting to management.

Major Duties and Responsibilities

25%                    Responsible for collection of accounts, including but not limited to soliciting payment arrangements on delinquent loans, interviewing members to determine reason for delinquency, taking appropriate action to resolve the account, counseling members concerning their financial obligations and offering suggestions and alternatives. Skip tracing as necessary to locate members and posting loan payments.

15%                    Respond to member inquiries, professionally, by phone and in person to discuss legal accounts to include payment arrangements, settlement offers and credit bureau disputes.

15%                    Prepares the required documentation for assignment to collection agencies or attorney. Attends court hearings for various legal files. Recommends and assists in preparing paperwork for delinquent accounts or charged off accounts. Ability to organize and complete legal paperwork in a timely and accurate manner.

10%                    Recommends and prepares legal referrals such as wage garnishment, levies and abstracts. 

10%                    Recommends and prepares accounts for replevin/seizure and files the appropriate documentation for assigned accounts. Oversees all replevin/seizure claims through dismissal.

10%                    Ensure member files are maintained in good order, and all required documents are filed (includes completion of adverse action forms).

  5%                    Prepare weekly collection update for Supervisor. Prepare monthly delinquency reports for Management and the Board.

  5%                    Monitor and process loan payoff information and provide this communication to attorney in an accurate and timely manner.

  5%                    Assigns accounts to third party collections agencies maintaining records of account activity. Processes daily charged-off share accounts. Returned Bank Item file processed daily. 

  -                        Must comply with all company policies and procedures, applicable laws and regulations, including but not limited to, the Bank Secrecy Act, the Patriot Act, and the Office of Foreign Assets Control.


Knowledge and Skills

EXPERIENCE

2-5 years of similar or related experience, including preparatory experience

EDUCATION/CERTIFICATIONS/LICENSES

A 2-year college degree or completion of a specialized course of study at a business or trade school requiring approximately 64 credit hours.

INTERPERSONAL SKILLS

A significant level of trust, credibility and diplomacy is required. In-depth dialogue, conversations and explanations with members, direct and indirect reports and outside vendors can be of a sensitive and/or highly confidential nature. Communications may involve motivating, influencing, educating and/or advising others on matters of significance. Typically includes subject matter experts as well as first level to middle managers.

PHYSICAL REQUIREMENTS

Perform primarily sedentary work with limited physical exertion and occasional lifting of up to 10 lbs. Must be capable of climbing / descending stairs in emergency situation. Must be able to operate routine office equipment including telephone, copier, facsimile, and calculator. Must be able to routinely perform work on computer for an average of 4-6 hours per day. Must be able to work extended hours whenever required or requested by management. Must be capable of regular, reliable and timely attendance.

WORKING CONDITIONS

Must be able to routinely perform work indoors in climate-controlled private office with minimal noise.

MENTAL AND/OR EMOTIONAL REQUIREMENTS

Must be able to perform job functions independently and work effectively either on own or as part of a team. Must be able to plan and direct the work activities of self and others. Must be able to read and carry out various complicated written and oral instructions.Must be able to speak clearly and deliver information in a logical and understandable sequence. Must be capable of dealing calmly and professionally with numerous different personalities from diverse cultures at various levels within and outside of the organization and demonstrate highest levels of member service and discretion when dealing with the public. Must be able to perform responsibilities with composure under the stress of deadlines / requirements for extreme accuracy and quality and/or fast pace. Must be able to effectively handle multiple, simultaneous, and changing priorities. Must be capable of exercising highest level of discretion on both internal and external confidential matters.
